The Spanish Customs operate to their own rules; I lived in Spain while owning my first boat She was registered in UK and the Customs inspected my boat often and always mentioned the boat had to be registered in SP. The important point are the taxes levied beyond the EU tax of 20%… add another 20% to your costs. Verify with a SP tax lawyer. thank you Bas, did you have any trouble with the spanish authorities beeing in Spain for some years with a foreign flag? Or did you hear of someone who had trouble? My prospective spanish buyer told me that boats with flags from Netherlands and Belgium now must be registered in Spain when they stay permantly in Spain. Alexander, In the spanish regulations I read: Upon registration of a vessel in Spain: - all boats must undergo an inspection of seaworthyness by 'collaborating inspection entity' to get the certificate of seaworthyness of the 'maritime authority'. - boats with a CE mark (cert.of conformity) are excluded from this inspection / cert.of seaworthyness. -this inspection must be done every 5 years. -in the capitaneria they should be able to point you to an 'collaborating inspection entity'. - Spanish citizens are to pay 14% tax over the value of their vessel every year. Sharkies are made before CE marks were invented by EU. It seems to me the inspection is the route to go, if you still really want a red-yellow-red flag. Hi Alexander, have you looked at alternatives to Spanish flag? I am resident in spain and I understand many Spanish citizens use other countries flags due to some of the onerous requirements of the Spanish flag.
When we recently bought our boat which was VAT paid but US flagged we looked at a couple of alternatives, and opted to register her in Poland on the grounds that the process is simple, quick and cost effective. So far we have seen lots of other polish boats around the mediterranean and not experienced any problems. How can exists a Declaration of Conformity for something that does not have had any rules during the time the item was produced?

Hi, that is quite strange as I have been several time in Rosas and Palamos with Maramu #17 built in 79 and was never asked about this paper...just the french registration. Then it may linked to your flag, if you're outside the EU......

To my knowledge; used boats and yachts built before 16 june1998 and already put in service within the EU do not require a CE mark (declaration of conformity) Since a Sharki would be built in France well before 1998 and probably taken into service as well, the requirement may not be valid. But you probably need to prove the history the boat, given that the officials are aware of the exemption.
