VAT in the EU

I'm having some equipment installed in Germany this summer.  One supplier is indicating that he can deliver the equipment without charging VAT as my boat is under temporary importation in the EU.  Another is saying that he can’t deliver without charging VAT but that I can get the VAT back from him once I provide some customs form.  I’ve tried to research the issue but not found a comprehensible answer.  Has anyone encountered the issue and can help?

I believe this happens frequently in the EU and other countries. When it happened to me it was because either the vendor was unaware of the law,, or the vendor did not have a license to ship without VAT. Some countries call this an export license.

Both are right!

 

In practice, it will very much vary according to the goodwill, or lack thereof, of the Customs Officer certifying that the goods are exported out the EU.

In theory, and also occasionally in practice, a manufacturer’s invoice stamped by Customs as “exported” allows the manufacturer not to charge VAT (or, if already charged to reimburse it).

The reality is that most Customs Office will require the standard procedure which is:

1) The exporter (manufacturer) must have an EORI (Economic Operators Registration and Identification), essentially an identification number for Customs purpose

2) If already registered with Customs the exporter (manufacturer) can use the so-called “Delta G” on-line procedure to fill the necessary paperwork.

 

Now that you are thoroughly confused, my guess is that your best solution, if you speak German, is to give a call, or visit, the Customs office that will deal with your case and check directly with them.

All supplies to boats of foreign flag are free of VAT. Even if it is under temporary importation. Supplier must make export declaration to customs (IE529) and he gets confirmations that goods has left when you leave (IE599) or if he is more aware of law he may use  other solution for equipment :
Let us remind you that the possibility of applying the 0% VAT rate for the supply of parts and equipment built-in or used for operation:
 
vessels used for navigation on the high seas and carrying passengers for reward or used for commercial, industrial or fishing purposes
marine rescue ships and lifeboats used at sea,
vessels used for inshore fishing
, which is the implementation of art. 148 lit. c) Directive 2006/112/EC of the Council of 28 November 2006 on the common system of value added tax (hereinafter: Directive 112) and functioning in the VAT Act since its adoption in 2004.

But beware about customs duties by brokers if you order through them . And on some countries this can be same as VAT cost ….
